User Terms
1. Eligibility & Account Requirements
To use SoldSafe, you must be at least 18 years of age and a resident of the United States. By creating an account, you confirm that you meet these requirements.
SoldSafe accounts are personal accounts held by individuals. All Users — whether acting as a Buyer or a Seller — must complete identity verification before publishing or accepting a listing. Users agree to provide any information required by applicable law, including the INFORM Consumers Act, and acknowledges that SoldSafe may suspend listings, transactions, or accounts for non-compliance.
SoldSafe does not currently offer business or company accounts. You may not register or operate an account on behalf of a corporation, limited liability company, partnership, or any other legal entity. If you buy or sell items in the course of a business, you may use SoldSafe only as an individual and in your own name, and you remain solely responsible for your own tax, licensing, and regulatory obligations arising from your use of the platform.
Identity verification. On registration you must complete the following steps:
- Email address verification via one-time passcode (OTP)
- Mobile phone number verification via OTP/SMS
- Government-issued ID verification – your ID must match your selfie
- Selfie liveness verification
- Any other information requested by SoldSafe, in its sole discretion, to complete identity verification
SoldSafe reserves the right, in its sole discretion, to suspend or terminate any account at any time that does not meet, or no longer meets, these Eligibility and Account Requirements, or that is found to have provided inaccurate or fraudulent information during verification.
2. SoldSafe as Agent of Payee
For Transactions that utilize the SoldSafe Vault, Seller appoints SoldSafe to act in the limited capacity described in this Section solely for purposes of receiving, holding, releasing, reallocating, and refunding certain funds associated with a Transaction. SoldSafe provides the technology platform and related payment facilitation services that enable Buyers and Sellers to transact through the Services and may also provide protection benefits pursuant to the SoldSafe Protection Guarantee.
SoldSafe is not a buyer, seller, broker, auctioneer, escrow agent, trustee, fiduciary, guarantor, or party to the underlying sale transaction between Buyer and Seller. SoldSafe does not take ownership of any item listed, marketed, or sold through the platform. Except as expressly provided in this Section and in the applicable SoldSafe policies, SoldSafe's role is limited to facilitating the collection, conditional release, reallocation, and refund of funds in accordance with the applicable terms.
Payment processing services are provided by third-party payment processors and their partner financial institutions. Funds deposited into the SoldSafe Vault may be held by or through such service providers as described in the applicable SoldSafe policies.
(a) Appointment. Seller appoints SoldSafe as Seller's limited payment collection agent solely with respect to funds deposited into the SoldSafe Vault in connection with a Transaction ("Vault Funds"). Seller authorizes SoldSafe to receive, hold, release, reallocate, and refund Vault Funds in accordance with the SoldSafe terms, policies, and procedures, as in effect at the time the applicable Transaction is entered into.
(b) Discharge of Buyer's obligation. Buyer's payment of Vault Funds to SoldSafe satisfies Buyer's obligation to Seller for that amount to the same extent as if paid directly to Seller, in each case only to the extent those funds are actually received and finally settled by SoldSafe. Seller shall not seek payment from Buyer a second time for amounts so paid.
(c) Reversal. If any payment is subsequently returned, reversed, charged back, or otherwise fails to settle finally, the discharge in (b) is void as to that amount, Buyer's obligation to Seller for that amount is reinstated, and SoldSafe has no obligation to pay or advance that amount to Seller.
(d) Irrevocability. The appointment in (a) is irrevocable as to Vault Funds already deposited until the applicable Transaction has concluded and those funds have been released, refunded, or otherwise disbursed in accordance with the applicable terms.
(e) Nature of the role. SoldSafe is not a party to the contract of sale between Buyer and Seller. SoldSafe acts solely as Seller's limited collection agent and not as an escrow agent, trustee, fiduciary, or guarantor, and owes Seller no duty beyond those expressly set out in the applicable terms.
(f) Scope. SoldSafe is not responsible for collecting, holding, transmitting, or enforcing payment of any portion of the purchase price that is not deposited into the SoldSafe Vault.
(g) Changes. SoldSafe may amend the terms referenced in (a). Amendments apply prospectively to Transactions entered into after their effective date.
3. Fees & Payment Terms
SoldSafe charges a fixed platform fee to both Buyers and Sellers based on the transaction amount. Fees apply only to the amount processed through SoldSafe and are determined by the transaction range the sale falls within. All fees are displayed clearly at checkout before payment is submitted.
Transaction Range
Seller Fee
Buyer Fee
Up to $250
No fee
$0.99 - $3.99
$251 - $1,000
$3.99 - $9.99
$7.99 - $15.99
$1,001 - $5,000
$19.99 - $25.99
$24.99 - $34.99
$5,001 - $9,999
$39.99 - $49.99
$49.99 - $69.99
The Seller Fee is deducted from the payout upon release of funds. The Buyer Fee is added to the total amount at checkout.
Paying in full or by deposit. A Seller chooses, when creating a listing, how the Buyer pays: Pay in Full, where the Buyer pays the whole price at checkout, or Deposit, where the Buyer pays a deposit at booking and the balance falls due later. The payment type, the deposit type, the deposit amount, and how any remaining balance is to be paid are set by the Seller on the listing and are shown to you before you pay.
Deposit types. Where a listing uses a deposit, the Seller sets it as either Refundable or Non-refundable, and the deposit type is shown on the listing before you pay. If the transaction is cancelled, what happens to the deposit depends on the deposit type and on who cancels:
- Refundable deposit: the deposit is returned to the Buyer whether the Buyer or the Seller cancels. Where the Buyer cancels, the SoldSafe Buyer platform fee and payment processing fees are deducted from the refund, as set out in Section 6.
- Non-refundable deposit: where the Buyer cancels, the deposit is not returned to the Buyer. Where the Seller cancels, the deposit is returned to the Buyer in full.
A deposit must be at least $1.00 and less than the full listing price. Where a deposit has been paid, the remaining balance falls due at pickup.
The remaining balance. The Seller specifies whether the remaining balance is to be paid in the SoldSafe app, paid directly to the Seller outside the app, or chosen by the Buyer at the point the balance falls due. Where the Buyer chooses, that choice must be recorded in the SoldSafe app at pickup before a pickup code can be generated, applies to that transaction only, and cannot be overridden by the Seller.
Fees on deposit transactions. Where there is a remaining balance to be paid in the SoldSafe app, fees are calculated on the full transaction amount. Where the remaining balance is paid outside the app, SoldSafe fees are calculated on the deposit amount only, and the transaction range in the table above is determined by the deposit amount rather than by the listing price.
Amounts paid outside the app are not protected. Only money processed through SoldSafe is held in the SoldSafe Vault. Where any part of the price is paid directly to the Seller outside the app, that amount is not held in the Vault, is not covered by any SoldSafe guarantee, and cannot be refunded, reallocated, or reimbursed by SoldSafe. You will be shown a notice to this effect before you pay.
If the remaining balance is notfunded at pickup. Where the remaining balance is to be paid in the SoldSafe app, no pickup code will be generated until the full amount is held in the SoldSafe Vault. If the Buyer does not fund the remaining balance at pickup — including where a payment method is declined and no alternative method is used — the exchange cannot be completed in the app. The parties may reschedule, or either party may cancel, in which case the transaction is treated as a Buyer cancellation under Section 6 and a non-refundable deposit is not returned. Where the Buyer declines to proceed for a reason relating to the item itself, Section 8.4 applies instead.
Payment processing fees: (charged by our third-party payment processor) will be calculated based on the total amount transacted through SoldSafe and will be clearly displayed to you.
Payment clearing times: Payments made by ACH (bank transfer) may take 6–8 business days to clear and reach the Seller. Clearing times are set by our third-party payment processor and the banks involved, and are outside SoldSafe’s control.
Sales tax: Sales tax will be calculated based only on the amount transacted through SoldSafe and the Buyer's location and will be added to the item price. The applicable amount will be clearly displayed to you at checkout before payment is submitted. Any applicable sales tax on any amount not transacted through SoldSafe remain the responsibility of the parties. Any titled property, vehicles or land remain the responsibility of the Buyer and are not subject to tax calculations through SoldSafe.
First Transaction Promotion: SoldSafe fees are waived on your first completed transaction of $150 or more transacted through SoldSafe (as both Buyer and Seller) if it is completed within 30 calendar days of account creation. Standard fees apply to all subsequent transactions. Payment processing fees and sales tax apply to all transactions and are not waived as part of the First Transaction Promotion.
All fees are non-refundable once a transaction has been completed.
4. Seller Representations and Listing Accuracy
As a Seller, you represent and warrant that:
- You are the lawful owner of the item being listed, or are otherwise authorized to sell it.
- The sale complies with all applicable federal, state, and local laws, including, but not limited to any licensing, registration, and certification requirements.
As a Seller, you also confirm that the item listed is accurately described, including but not limited to:
- The item's condition (new, used, damaged, repaired, etc.)
- Any known defects, faults, or limitations
- Accurate photos showing the actual item — stock images are not permitted
- Correct category, title, and pricing
Listings that are found to be misleading, inaccurate, or fraudulent may be removed without notice, and the associated account may be suspended or permanently banned.
Buyers are encouraged to review all listing details carefully before publishing.
SoldSafe does not inspect, authenticate, certify, evaluate, test, endorse, or guarantee any item listed by a Seller.
5. Prohibited Items
The SoldSafe Prohibited Item List contains restrictions on what may be listed and/or transacted on the SoldSafe platform. By using the Services, you acknowledge and agree that the SoldSafe Prohibited Item List is incorporated into and form part of these Terms.
The current versions of the SoldSafe Prohibited Item List is available at:
Users are responsible for reviewing this list before participating in any transaction.
6. Cancellation Policy
Either the Buyer or Seller may cancel a transaction at any time before the scheduled pickup, subject to the following conditions:
If the Buyer cancels a transaction: The Buyer will receive a full refund of the amount paid, minus the SoldSafe Buyer platform and payment processing fees. Exception: if the Seller has set a non-refundable deposit, the deposit amount will not be returned in the instance of a buyer-initiated cancellation.
If the Seller cancels a transaction: The Buyer will receive a full refund of the amount paid, including the SoldSafe Buyer platform and payment processing fees. In the event of a Seller cancellation on a non-refundable deposit, the deposit amount will be returned to the Buyer.
Repeated cancellations: a Seller who cancels three or more transactions within any rolling 90-day period may have their account suspended and may be charged the full SoldSafe Seller Fee that would have applied to each cancelled transaction.
SoldSafe does not facilitate cash exchanges or cancellations agreed outside of the platform.
7. Reporting an Issue, Disputes & Claims
The SoldSafe Protection Guarantee and Dispute Resolution Policy contains important terms regarding available protection guarantees, exclusions, claim procedures, dispute processes, limitations, and user responsibilities. By using the Services, you acknowledge and agree that those policies are incorporated into and form part of these Terms.
The current versions of these policies are available at:
Users are responsible for reviewing this policy before participating in any transaction.
8. Accept, Reject & Fund Release
At the pickup, you as the Buyer are required to make an explicit decision — either Accept or Reject the item — before any applicable funds are released to the Seller. This decision is made within the SoldSafe app and is final.
8.1. Inspecting the Item Before You Decide
Before you confirm your decision, we ask you to carry out an inspection of the item. The app will prompt you to check the following:
- The item matches the photos and title shown in the listing
- You have powered on and tested basic functions (where applicable)
- You have checked for any damage not visible in the listing photos
You are responsible for completing this inspection before confirming acceptance. Once you accept, your decision cannot be undone.
8.2. Accepting the Item
If you are satisfied with the item, you may accept it within the SoldSafe app. Acceptance of an item is final and cannot be reversed.
8.3. The Pickup Code
The 6-digit pickup code is generated by the SoldSafe app only after you have completed the full acceptance flow — including the inspection confirmation and the final acceptance screen — and the payment conditions set by the Seller for that listing have been met:
- Where the remaining balance is to be paid in the SoldSafe app, the code is generated only once the full amount is held in the SoldSafe Vault.
- Where the Seller has agreed the remaining balance may be paid outside the app, the code is generated once the deposit is held in the Vault.
- Where the Buyer chooses at pickup, the code is generated once the Buyer has recorded that choice and, if paying in the app, funded the remaining balance.
No pickup code exists before that point.
Sellers: do not hand over the item before entering the code. Entry of the pickup code is the only record SoldSafe holds that an exchange took place. Where a Seller releases an item without entering a valid pickup code, SoldSafe can release only the amount held in the Vault, and any shortfall is a matter between the Seller and the Buyer.
After funds are released you may still report a problem with the transaction in accordance with the SoldSafe Protection Guarantee and Dispute policy found here.
8.4. Rejecting the Item
If you do not wish to proceed with the transaction at the pickup, you may reject the item within the SoldSafe app.
The Seller retains the item in all rejection scenarios.
A rejection is reviewed by SoldSafe before any refund is made. Where the Seller contests your rejection, the matter is handled as a Dispute in accordance with the SoldSafe Protection Guarantee and Dispute policy found here.
Refunds on rejection are made in accordance with Section 6, including where the listing was configured with a non-refundable deposit.
9. Automatic Release of Funds
If the Buyer does not confirm receipt of the item or report an issue within 24 hours of the scheduled pickup time, the transaction will be automatically considered complete and the funds then held in the SoldSafe Vault for that transaction will be released to the Seller. Only funds already held in the Vault are released. Where a deposit has been paid and the remaining balance has not been funded through the SoldSafe app, SoldSafe will release the deposit only and will not charge the Buyer for the unfunded balance. After funds are released you may still report a problem with the transaction in accordance with the SoldSafe Protection Guarantee and Dispute policy found here.
10. Chargeback Policy
SoldSafe is built on direct in-person transactions between verified Buyers and Sellers, with funds held safely in the third-party payment vault until both parties are satisfied. Because of this, almost every issue that might lead to a chargeback can be resolved faster and more fairly through the SoldSafe app than through your bank or card issuer.
10.1. Resolve directly with the other party first. Most issues — a delayed pickup, a question about the item, a minor discrepancy — are best resolved between the Buyer and the Seller directly. If you have a concern about a transaction, your first step should be to message the other party in the SoldSafe in-app chat and try to reach an agreement.
10.2. Use the Report an Issue process second. If you cannot reach an agreement with the other party, you should raise the issue through the Report an Issue process in the SoldSafe app before contacting your bank or card issuer. SoldSafe holds funds to make this possible — for as long as an issue is open in-app, the Seller cannot withdraw the funds. Initiating a chargeback bypasses this protection and almost always produces a slower and worse outcome for both parties than the in-app process.
10.3. No-chargeback agreement. By submitting payment through SoldSafe, you agree that you will not initiate a chargeback, payment reversal, dispute, or claim with your card issuer, bank, or any other payment provider in respect of a SoldSafe transaction without first:
- attempting in good faith to resolve the issue directly with the other party in the SoldSafe in-app chat; and
- reporting the issue through the Report an Issue process in the SoldSafe app and allowing SoldSafe a reasonable opportunity (and at least 5 working days) to reach a resolution.
10.4. Your statutory rights. Nothing in this section is intended to limit or waive any rights you have under applicable US federal or state law, including your rights under Regulation Z (12 CFR §1026.12) and the Fair Credit Billing Act to dispute a charge with your card issuer. This section sets out the order in which you have agreed to seek a resolution, not whether you are entitled to one.
10.5. Chargeback handling fee. Where you initiate a chargeback in breach of Section 10.3, SoldSafe may charge you a chargeback handling fee of $25 per chargeback to cover the cost of investigating and responding to it. SoldSafe may recover that fee, together with any amount SoldSafe is required to pay as a result of the chargeback, from your SoldSafe balance or from your registered payment method, and may suspend or terminate your account.
10.6. Sellers and chargebacks. Sellers acknowledge that a chargeback raised by a Buyer may, where the card issuer upholds the chargeback, result in the disputed amount being reversed from the Seller's payout or recovered from the Seller's SoldSafe balance. Where SoldSafe successfully defends a chargeback on the Seller's behalf, no amount will be recovered from the Seller; SoldSafe will not charge the Seller the chargeback handling fee, which is borne by the Buyer in accordance with Section 10.5.
10.7. Cooperation. You agree to provide SoldSafe with any information, evidence, or documentation reasonably required to defend a chargeback, and you authorize SoldSafe to share transaction records, in-app chat history, identity verification status, and dispute documentation with the relevant card networks, card issuers, banks, and payment processors as part of any chargeback investigation.
11. Unclaimed Funds
SoldSafe holds funds on behalf of Users from time to time through its third-party payment processor. These include Seller payouts awaiting withdrawal, Buyer refunds following a cancelled or disputed transaction, and any deposit balances pending release. This section explains what happens to those funds if your account becomes inactive.
11.1. What counts as a SoldSafe balance. A "SoldSafe balance" means any money that SoldSafe is holding for you and which you have the right to withdraw or apply to a future transaction, including:
- Seller payouts that have been released from the payment vault but not yet transferred to your linked bank account;
- Buyer refunds that have been credited to your SoldSafe account but not yet returned to your original payment method;
- Buyer deposit balances that are due to be returned to you following cancellation or completion of a transaction; and
- any other amount held by SoldSafe for your benefit.
11.2. When your account is treated as dormant. Your SoldSafe account will be treated as dormant if, for a continuous period of 12 months, you do not log in to the SoldSafe app or website, complete a transaction, withdraw a SoldSafe balance, or otherwise interact with the platform in a way that demonstrates ownership of the account.
11.3. Our outreach to you. When your account becomes dormant and you have a SoldSafe balance, we will make reasonable efforts to contact you before any further action is taken. These efforts will include:
- sending one or more emails to the email address on file with your SoldSafe account; and
- sending an in-app and/or push notification (where you have a registered device).
Each notice will explain that your account is dormant, that your balance is being retained by SoldSafe, and what you need to do to have those funds returned to you.
11.4. Retention of unclaimed funds. Where your account remains dormant and you have not responded to our outreach, SoldSafe will retain your SoldSafe balance. SoldSafe will deduct any fees, charges, or amounts owed to SoldSafe under these Terms before retaining the remaining balance. Retained funds are not remitted to any state or government authority.
11.5. How to claim your funds. Your SoldSafe balance remains claimable by you at any time. To have retained funds returned, you must contact SoldSafe directly at support@soldsafe.com. Upon satisfactory verification of your identity and account ownership, SoldSafe will return your balance, less any fees or charges properly owed to SoldSafe under these Terms, to your nominated bank account or original payment method.
11.6. Keeping your information up to date. To ensure we can reach you and process any return of funds efficiently, you must keep your email address, mobile phone number, and registered address up to date in your SoldSafe account settings. SoldSafe is not responsible for missed notifications where this is caused by out-of-date contact information.
11.7. Reactivating a dormant account. You may reactivate a dormant account at any time by logging in to the SoldSafe app or website and confirming your identity if prompted. On reactivation, your SoldSafe balance will be restored in full, less any fees or charges properly owed to SoldSafe under these Terms.
12. In-App Chat and User Conduct
SoldSafe provides a messaging channel within each transaction so that the Buyer and the Seller can coordinate the exchange. This Section sets out how that channel may be used, what is prohibited, and the steps SoldSafe takes to keep it safe. It applies to all messages, images, and files sent through the SoldSafe app.
12.1. Purpose of in-app chat. A chat thread opens automatically when a transaction is created and is available only to the Buyer and the Seller for that transaction. SoldSafe does not offer public messaging, messaging outside an active transaction, or group messaging. Chat is provided for coordinating the exchange — asking questions about the item, arranging the pickup time and place, and resolving any concern before it is escalated.
12.2. How to communicate. When using SoldSafe chat, you should:
- keep your messages relevant to the transaction and the pickup;
- be courteous and assume good faith — most disagreements are resolvable between the parties;
- arrange to meet in a safe, public place;
- never share bank account details, card numbers, passwords, or one-time passcodes in chat — SoldSafe will never ask you for them; and
- try to resolve any concern with the other party in chat before using the Report an Issue process, in accordance with Section 10.1.
12.3. Prohibited conduct. You must not use SoldSafe chat, or any other part of the Services, to send, post, upload, or share:
- harassment, bullying, intimidation, stalking, or threats of violence;
- hate speech, slurs, or content that demeans or attacks a person or group on the basis of race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, age, or any other protected characteristic;
- sexually explicit or sexually suggestive content, or nudity;
- any content that sexualizes, exploits, or endangers a minor;
- fraudulent, deceptive, or misleading content, including impersonation, phishing, and any attempt to obtain another User’s personal, financial, or account information;
- offers, solicitations, or arrangements relating to any item on the SoldSafe Prohibited Item List referred to in Section 5, or to any other illegal goods or services;
- another person’s personal information, shared without that person’s consent;
- unsolicited advertising, spam, chain messages, or promotion of other platforms, goods, or services; and
- software viruses, malware, or any file intended to damage, disable, or gain unauthorized access to any device, account, or system.
You must also not use chat in any way that violates applicable law or any other provision of these Terms.
12.4. Child safety. SoldSafe has zero tolerance for content that sexualizes, exploits, or endangers a minor. Any such content will result in the immediate and permanent termination of your account without notice, and will be reported to law enforcement and to the National Center for Missing & Exploited Children as required by applicable law.
12.5. Reporting and blocking. You may report a message or a User directly from the in-app support functionality, and you may block another User. Blocking prevents that User from sending you further messages, sharing further listings with you, or starting a new transaction with you, and remains in effect after the transaction has ended. Blocking does not by itself cancel a transaction already in progress or release funds held in the SoldSafe Vault; where a transaction needs to be resolved, contact SoldSafe at support@soldsafe.com. You may also report conduct to SoldSafe at that address at any time.
12.6. Monitoring and automated screening. Messages, images, and files sent through SoldSafe chat are screened automatically before they are delivered, and content identified as prohibited may be blocked, withheld, or removed. Chat content may also be reviewed by SoldSafe personnel for the purposes of safety, fraud prevention, dispute resolution, and legal and regulatory compliance, and may be shared as described in Section 10.7. Screening may be carried out with the assistance of third-party service providers. Chat content is retained and handled in accordance with the SoldSafe Privacy Policy. Automated screening is not exhaustive and does not guarantee that every prohibited message is detected or prevented. You remain responsible for your own conduct in chat and for your own safety when meeting another User in person.
12.7. Our response to reports. SoldSafe aims to review reports of prohibited conduct within 24 hours. Where SoldSafe determines that this Section has been breached, it may take any action it considers appropriate, including removing or withholding the content, issuing a warning, suspending the account, permanently terminating the account, cancelling any affected transaction and refunding the Buyer in accordance with Section 6, and reporting the matter to law enforcement. SoldSafe may take such action without prior notice where it considers it necessary to protect Users or the platform.
Seller Fee
Buyer Fee
Up to $250

- Seller payouts that have been released from the payment vault but not yet transferred to your linked bank account;
- Buyer refunds that have been credited to your SoldSafe account but not yet returned to your original payment method;
- keep your messages relevant to the transaction and the pickup;
- be courteous and assume good faith — most disagreements are resolvable between the parties;
- arrange to meet in a safe, public place;
- harassment, bullying, intimidation, stalking, or threats of violence;
- hate speech, slurs, or content that demeans or attacks a person or group on the basis of race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, age, or any other protected characteristic;
- sexually explicit or sexually suggestive content, or nudity;
- any content that sexualizes, exploits, or endangers a minor;
- fraudulent, deceptive, or misleading content, including impersonation, phishing, and any attempt to obtain another User’s personal, financial, or account information;
- offers, solicitations, or arrangements relating to any item on the SoldSafe Prohibited Item List referred to in Section 5, or to any other illegal goods or services;
- another person’s personal information, shared without that person’s consent;
- Seller payouts that have been released from the payment vault but not yet transferred to your linked bank account;
- Buyer refunds that have been credited to your SoldSafe account but not yet returned to your original payment method;
- keep your messages relevant to the transaction and the pickup;
- be courteous and assume good faith — most disagreements are resolvable between the parties;
- arrange to meet in a safe, public place;
- harassment, bullying, intimidation, stalking, or threats of violence;
- hate speech, slurs, or content that demeans or attacks a person or group on the basis of race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, age, or any other protected characteristic;
- sexually explicit or sexually suggestive content, or nudity;
- any content that sexualizes, exploits, or endangers a minor;
- fraudulent, deceptive, or misleading content, including impersonation, phishing, and any attempt to obtain another User’s personal, financial, or account information;
- offers, solicitations, or arrangements relating to any item on the SoldSafe Prohibited Item List referred to in Section 5, or to any other illegal goods or services;
- another person’s personal information, shared without that person’s consent;
